This Privacy Policy describes, among other things, how your personal data will be processed when you use Sendify’s [logistiktjänst] (the “Service”), visit www.sendify.se (the “Website”), or contact us. It also describes your rights and how you can exercise them.
Sendify is the controller for how we process your personal data in accordance with this policy. You can always expect your personal data to be handled securely and fairly. When you use the Service, you will likely process personal data about other individuals, such as the names, email addresses, phone numbers, and addresses of recipients, senders, and other parties connected to a shipment. Sendify processes this data on behalf of you or your employer (i.e., in the capacity of processor).
If you have received a shipment sent using the Service and have questions about the processing of your personal data, you should first contact the company that booked the shipment.
1. Personal data collected about you
Sendify may collect and process different types of personal data about you, for example when you use the Service or contact us. Sendify may process the following categories of personal data about you:
- Contact details, such as name, email, phone number, and address.
- Account details, such as name, profile image, email, phone number, and password.
- Booking details, such as your booking history and other information about shipments you book in the Service.
- Company details, such as information about the company you work for (typically your employer), including company name, your title, workplace, and sometimes information about your authority to represent the company.
- Communications, such as information you include in free-text fields on the Website, in the Service, or in your emails to us, or that you otherwise provide to us.
- Device information, such as IP address, language, browser, operating system and screen resolution, as well as information about when and how you use the Website or the Service.
- Sensitive personal data. Sendify only collects and processes sensitive personal data (e.g., information about illness) where it is justified and necessary. Sensitive data will be handled with extra care. Because email is not always completely secure, please avoid including sensitive personal data in emails to us.
2. How your data are collected
- Information you provide to us. You typically provide most of the information yourself, for example when you register your account in the Service, book a shipment, or when you communicate with us. Providing information to us is voluntary. However, certain information must be provided in order to use the Service. If you do not provide the requested information, it may prevent the performance or delivery of shipments or other services that you or your employer expect from us.
- Information collected in other ways. Sendify may also obtain information about you from other sources. For example, information may be provided to us when one of your colleagues invites you to the Service. Sendify may also have obtained your contact details from providers of contact information, your employer’s website, or other public sources.
- When you visit the Website or use the Service, device information is collected from your computer (or mobile device). This information is collected using cookies.
3. How your data are used
Sendify primarily uses your personal data to provide the Service to you, to communicate with you, and to book and administer your shipments.
Please note that processing may differ depending on your relationship with us, for example whether you contact us as a private individual or as a representative of a company (e.g., an existing or potential customer, supplier, or partner). Not all of the processing activities listed below will necessarily apply to you.
Sendify processes personal data for the following purposes and on the following legal bases:
- To provide the Service. Your personal data will be processed to administer your user account and to provide the Service to you (i.e., to perform the contract between us). For example, your email and password are used to verify your identity when you log into the Service; booking details are used to carry out your bookings in the Service; and device information is used to ensure the Service is presented in the best way for you and your device.
- To enter into and perform contracts. Your personal data may be processed to enter into contracts with you or your employer and to perform such contracts. This also includes actions needed prior to entering into the contract. This processing is necessary for Sendify to enter into and perform contracts with you or your employer and for other legitimate interests, including Sendify’s interest in entering into and performing various types of agreements.
- To provide support and communicate with you and others. Your personal data (e.g., name, email, and phone number) may be used to communicate with you and others, for example in connection with your use of the Service. Your personal data may be needed to investigate, respond to, and resolve complaints and issues with the Service or shipments. This is necessary to provide the Service and for other legitimate interests, including Sendify’s interests in the proper functioning of the Service and in communicating effectively with you and others.
- To manage invoices and payments. Your personal data may be used to invoice your employer for completed shipments and other agreed remuneration, for example by listing you as the invoice reference. This is necessary for Sendify to receive payment.
- To conduct customer surveys. Your contact details may be used to conduct customer surveys, for example to ask for your thoughts about Sendify and the Service. Participation in surveys is voluntary. The data collected in connection with customer surveys may be used to support Sendify’s legitimate interest in improving the Service.
- To market Sendify’s services. Your name and email may be used to send you newsletters, information about the Service, and invitations to events. This is based on legitimate interests, including Sendify’s interest in marketing the Service. If you no longer wish to receive such information, you can unsubscribe by following the instructions at the bottom of the email you received from us or by contacting us at [info@sendify.se].
- To comply with laws. Sendify is required to comply with Swedish law. This means your personal data may sometimes need to be processed to the extent required by law or other legal obligations, for example for reporting to authorities.
- To protect Sendify, you, and others. Sendify may process your personal data where necessary to defend or assert our, your, or others’ legal rights, business interests, or other legitimate interests. This may be necessary if you or someone else brings claims against us, for example in connection with potential complaints. This is necessary to protect you and others and for other legitimate interests, including Sendify’s interest in being able to respond to claims and complaints.
- To create aggregated statistics. Your personal data (e.g., booking details and device information) may be used to create statistics in aggregated form, where the data cannot identify you. Such statistics may concern recurring types of bookings, average prices, and the geographical distribution of users in the Service. This is based on legitimate interests, including Sendify’s interests in developing and improving the Service and its use.
- To develop and improve the Service. Device information and aggregated statistics may be used as a basis for continuously developing and improving the Service and new services. This is based on legitimate interests, including Sendify’s interests in developing and streamlining the Service and the user experience.
- With your consent. Your personal data may also be used for other specific purposes than those stated above if you ask us to do so or allow us to do so. For example, with your consent Sendify may publish a testimonial you provide or include you in articles about customer assignments to market Sendify’s services.
4. How your data are shared with others
Sendify may sometimes need to share your personal data with other trusted people and companies. For example, your personal data may be shared with:
- People who work for us. Your personal data will be shared with people who work at Sendify, but only with those who need access to perform their job duties. For example, Sendify’s customer support will access your personal data to assist you in the best possible way.
- Group companies. Sendify is part of the same group as SPOC Logistics Group AB and Express Delivery Sweden AB. Your personal data may sometimes need to be shared between these group companies, for example so the companies can centralize systems and collaborate with each other.
- Service providers. Your personal data will be shared with selected companies that help us deliver the Service and the Website, such as providers of IT and financial services. These companies may process your personal data only according to our instructions or to fulfill their legal obligations. Sendify works only with reputable and carefully selected providers, so your personal data are in safe hands. For example, Sendify uses Intercom as the customer service system, Surveymonkey for customer surveys, and Fortnox helps us send and ensure payment of your invoices. The Service is hosted and provided using the Amazon Web Services (AWS) cloud platform.
- Carriers. When you book a shipment in the Service, Sendify will send your booking details (including your contact details if you have listed yourself as the contact person) to the carrier. You can see the carrier’s name before you book the shipment. The carrier is the controller for how it processes your personal data. You can read more about this on the carrier’s website.
- Authorities and legal contexts. Your personal data may sometimes need to be shared with authorities, courts, and other parties. For example, if required by law, in connection with legal proceedings, or to respond to a request from supervisory authorities or other public authorities.
- Corporate transactions. For strategic or business reasons, Sendify may in the future decide to sell or transfer all or parts of the company. As part of such a transaction, your personal data may need to be shared with parties involved in the process.
- Other parties. Your personal data may also be shared with other parties if you ask us to do so or allow us to do so. For example, you may be included in email conversations together with external parties.
5. Your data may be processed outside the EU/EEA
Sendify always strives to process your personal data within the EU/EEA. However, your personal data may sometimes need to be transferred to companies outside the EU/EEA. For example, your personal data may be transferred to Mailchimp in connection with the sending of newsletters, which, among other things, will process your data in the United States.
You should be aware that different rules may apply to your personal data outside the EU/EEA, which may sometimes entail a lower level of protection. However, Sendify will ensure that reasonable legal, technical, and organizational measures are in place to ensure your personal data are handled securely and with an adequate level of protection (e.g., approved standard contractual clauses and the so-called Privacy Shield). You can always contact us if you have questions about the safeguards in place.
6. How long your data are stored
Sendify stores your personal data for the shortest time possible and only as long as justified for the purpose of the processing. The retention period may depend on the type of data. The same data may sometimes be stored for different purposes. For example, data may be retained for invoicing and accounting even after it has been deleted for other purposes.
Sendify regularly reviews the need to store your data, taking applicable legal requirements into account. Generally, your personal data are stored for the duration of the contractual relationship—that is, for as long as Sendify provides services to you or your employer. Normally, your data also need to be stored for a period thereafter due to potential complaint periods. Your account details are stored in the Service for as long as you keep your user account.
Personal data processed on the basis of your consent are deleted if you withdraw your consent. Note that this does not affect Sendify’s right to process the data prior to the withdrawal. Your data may also be stored for a longer period if required by law, for example tax and accounting laws. In such cases, your data will be used only to fulfill those obligations.
7. Cookies
Like many others, Sendify uses cookies and similar technologies on the Website and in the Service to collect device information. You can control cookie settings in your browser settings. More information about our cookies.
8. Your rights
It is your personal data. You therefore have the right to receive information about and influence how we process your personal data. Below is a brief summary of your rights:
- Right to object to processing. You have the right to object to processing of your personal data based on legitimate interests. You can contact us to obtain more information about the balancing of interests that has been carried out.
- Right of access and data portability. You may request a copy of your personal data at any time and information about how they have been obtained, used, shared, etc. In some cases, you also have the right to transfer your personal data to another controller.
- Right to erasure. You have the right to request that personal data about you be deleted if the data are no longer necessary for the purpose for which they were collected or otherwise processed, or if there is no legal basis for processing the data.
- Right to rectification. You have the right to request the correction of inaccurate personal data about you. You also have the right to complete incomplete personal data.
- Right to restriction. You have the right to request that the processing of your personal data be restricted until inaccurate data have been corrected or an objection from you has been handled.
- Right to withdraw consent. You have the right to withdraw any consent you have given to us at any time. Note, however, that this does not affect processing carried out before the withdrawal.
If you ask Sendify to restrict or delete your personal data, this may affect or prevent your use of the Service. You should also be aware that there may be statutory rules that limit or extend your rights. For example, legal obligations may prevent or entitle us not to disclose, delete, or transfer parts of your data.
9. Complaints
You have the right to contact and lodge a complaint with the Swedish Data Protection Authority (Datainspektionen) if you believe your personal data have been handled incorrectly by us. 10. Updates to this policy
This policy may occasionally need to be changed or updated, for example if features in the Service are changed or added. If any significant changes are made, you will be informed in the Service or in another appropriate manner, to allow you to consider the change before it takes effect. You should also read this policy from time to time to ensure you are aware of any changes that have been made.
